933.10 WASTE DISCHARGE MONITORING.
   (a)    Control Manholes. When required by the Director, industrial users shall install a suitable control manhole(s), together with necessary samplers, meters, recorders and other appurtenances to adequately sample and measure the wastes discharged.
   There shall be ample room in or near such sampling manhole or facility to allow accurate sampling and preparation of samples for analysis. The facility, sampling and measuring equipment shall be maintained at all times in a safe and proper operating condition at the expense of the user.
   Whether constructed on public or private property, the sampling and monitoring facilities shall be provided in accordance with the City's requirements and all applicable local construction standards and specifications. Construction shall be completed within ninety days following written notification by the Director.
   (b)    Sampling and Analysis. The Director may require the industrial user to supply information on wastewater flow and characteristics. This information shall be of a type specified by the Director and may require disclosure on the nature of the industrial process.
   Wastewater analysis shall conform to Federal EPA Regulations on Test Procedures for the Analysis of Pollutants (40 CFR 136; 38 FR 28758, October 16, 1973), which shall be available from the Director. However, alternative methods for certain analysis of pollutants may be used subject to mutual agreement between the Director and the industrial user. The user shall pay the costs incurred in the sampling and analysis program, including control manholes.
   (c)    Powers and Authority of Inspectors. Whenever it is necessary for the purposes of these rules and regulations, the Director, his authorized representative(s) and the agents of the Federal and State EPA, may immediately enter upon any property, where wastewater is created or discharged, upon presentation of proper credentials and identification for the purposes of inspection, observation, measurement and sampling and testing.
   While performing the necessary work on the private properties referred to hereinabove, the Director and his duly authorized representatives shall observe all safety rules established by the person for the premises and the person shall be held harmless for injury or death to the City employees, and the City shall indemnify the person against loss or damage to its property by City employees and against liability claims and demands for personal injury or property damage asserted against the person, except as such may be caused by negligence or failure of the person to maintain safe conditions as required by subsection (a) hereof.
