905.02 PORTABLE ATHLETIC DEVICES RESTRICTED.
   (a)   Permanent and portable athletic devices endanger children and pedestrians using the City sidewalks and motorists driving on public streets.
   (b)   All permanent and portable athletic devices, such as basketball hoops and backboards, are not permitted to be erected on City property, including all easements, public streets and sidewalks.
   (c)   Nothing in this section shall prohibit the setting aside of streets or sections thereof for limited periods of time, for playground purposes by the officials of the City having charge thereof.
   (d)   Notice shall be given to any homeowner or renter in violation of this section by either the Safety-Service Director or Police Department to remove such devices within three days. If not removed, the City Street Department will impound such devices and only be released to the parent or guardian after a fine has been paid.
   (e)   Whoever violates any provision of this section is guilty of a minor misdemeanor on a first offense; on a second offense, the person is guilty of a misdemeanor of the fourth degree; on each subsequent offense, the person is guilty of a misdemeanor of the third degree.
