905.06 TILING OF ROADSIDE DITCHES WITHIN THE CITY ROAD RIGHT OF WAY.
   (a)    A permit to tile ditches within the road right of way must be obtained at the City Service Department, 2094 State Route 303. Inspections must be made prior to, during and after completion of project.
   (b)    The site of the drive pipe under the driveway shall determine the size of tile that is to be placed in the ditch. A twelve inch inside diameter will be the minimum size allowed. If in doubt of tile size, contact the Director of Public Service.
   (c)    A riser of the same size tile used and grate shall be placed on the up-hill side of the driveway and at intervals of each 100 foot. A one foot deep swale in the finished dirt cover over tile shall be left for water drainage off roadway.
   (d)    The City will not be responsible in any way, expressed or otherwise, in the purchasing, installing, covering or maintenance of any tiled roadside ditch.
   (e)    Roadside ditches may be tiled with concrete pipe, corrugated metal pipe, or corrugated plastic pipe. The minimum pipe size shall be twelve inches, inside diameter, or whatever dimension is recommended by the Director of Public Service.
   (f)   Below are sketches to assist and explain tile regulations.

   (g)   Where the Director of Public Safety and the Director of Public Service determine that a roadside ditch within the City road right-of-way constitutes a public nuisance that can be abated by the tiling of such ditch, the Director of Public Service may purchase and install tile pipe within such ditch to abate the nuisance condition, notwithstanding Section 905.06(d). Once installed, the maintenance of the tiled ditch shall be the responsibility of the landowner. Such pipe shall be purchased from funds appropriated, and unencumbered, within a line item of the Service Department budget.
