The provisions of this chapter shall not apply to or affect the following persons or sales:
(A) Persons selling goods pursuant to an order or a process of a court of competent jurisdiction;
(B) Persons acting in accordance with their powers, duties and authority as public officials;
(C) Any persons selling or advertising for sale an item or items of personal property which are specifically named or described in an advertisement within the classified section of a local newspaper and not otherwise advertised as a garage sale;
(D) Sales by a religious, charitable or service organization, the proceeds of which are used for religious, charitable or community service purposes;
(E) Sales conducted by an auctioneer or duly licensed under the laws of the state; and
(F) Any sale conducted by any merchant or mercantile or other business establishment from or at a place of business wherein such sale would be permitted by the zoning ordinances or under the protection of a presently non-conforming section thereof, or any other sale conducted by a manufacturer, dealer or vendor, which sale would be conducted from properly zoned premises and is not otherwise prohibited; provided, however that any such business sale shall be subject to the following rules and regulations:
(1) No such sales shall be conducted from any public street or sidewalk, nor shall any public street or sidewalk be permitted to be encumbered with barrels, boxes, cans, articles or substances of any kind so as to interfere with the free and unobstructive use thereof;
(2) No such sales shall be conducted from motor vehicles or any other non-permanent business establishments, located either on the public streets, rights-of-way or sidewalks within the village; and
(3) Any items offered at such sale or at a sidewalk sale shall be removed into the adjoining business establishment every evening of said sale.
