§ 91.01 OHIO FIRE CODE.
   (A)   Adoption of Ohio Fire Code. The Ohio Fire Code, Inc., as adopted by the Ohio Division of State Fire Marshal, Department of Commerce, O.A.C. Chapter 1301:7-7 is herein incorporated by reference.
   (B)   Purpose of Ohio Fire Code. The purpose of the Ohio Fire Code as adopted herein is to prescribe minimum standards and regulations governing conditions hazardous to life and property from fire or explosion.
   (C)   Application of Ohio Fire Code. The Ohio Fire Code as adopted herein applies to the use of all lands and properties within the village and such other lands or properties owned by the village which are situated outside the corporate limits thereof.
   (D)   Enforcement of Ohio Fire Code.
      (1)   No person shall serve as Fire Safety Inspector unless that person has received a certificate issued under R.C. § 4765.55 evidencing that person’s satisfactory completion of a fire safety inspection training program.
      (2)   For village criminal proceedings, the complaint, warrant or summons, or the issuance of a citation in minor misdemeanor cases shall, as prescribed in the Ohio Rules of Criminal Procedure, reference the numerical designation of the applicable village ordinance, including the specific provision of the Ohio Fire Code, or any order issued pursuant thereto, that is violated; provided that if the change is violation of an order, such order fixes a reasonable time for abatement of the violation.
      (3)   A copy of such complaint or citation shall be prominently posted at or near each place where a violation referred to occurs.
      (4)   Upon request of the Fire Safety Inspector, the Village Prosecutor shall institute and prosecute any necessary action or proceeding to enforce this chapter or R.C. Chapter 3737.
   (E)   Compliance with Ohio Fire Code.
      (1)   No person shall knowingly violate any provision of the Ohio Fire Code as adopted herein or any issued pursuant thereto.
      (2)   No person shall fail to comply with the fire prevention measured or fire protection activities as prescribed in the Ohio Fire Code, or fail to obtain a permit or license for the various uses or activities as required by such Code, or fail to comply with the village application and plan submission and processing requirements including payment of the fees designated therefor.
