§ 35.01 OVERTIME COMPENSATION.
   (A)   (1)   Overtime compensation of one and one-half times their regular rate of pay shall be paid to all non-exempt employees who work in excess of eight hours in one day during their normal work day; provided the same has been approved and noted on their time sheets in advance by their supervisor, and further providing that there shall be no pyramiding of overtime pay, it being specifically intended that employees shall not be paid additional overtime for hours worked in excess of 40 hours per week if they have already been paid overtime on a daily basis as set forth above.
      (2)   Working overtime is generally discouraged and usually will be performed only when the employer determines it is necessary. All overtime must be approved in advance by the employee’s supervisor, except in unusual or emergency situations. The employer will examine closely any overtime requests not approved in advance. Scheduled overtime which is subsequently cancelled for any reason shall not entitle the employee to overtime compensation.
   (B)   Non-exempt employees may elect to take compensatory time off in lieu of receiving cash payment for overtime work, said compensatory time off to be at the rate of one and one-half hours off for each hour of overtime worked, under the following conditions:
      (1)   Compensatory time shall be limited to a maximum accrual per calendar year of 40 hours;
      (2)   At no time shall an employee be allowed to accumulate more than 40 hours of compensatory time; and
      (3)   Request for using compensatory time must be made to a supervisor who may allow or not allow the use of compensatory time in the supervisor’s sole discretion.
