903.02 ANNUAL PAVEMENT CRACK SEAL PROGRAM. 
   (a)    This Annual Pavement Crack Seal Program (Program) consists of crack sealing city streets pursuant to the most current version of the State of Ohio, Department of Transportation’s Construction and Material Specifications, Item 423 Crack Sealing, Hot Applied, Type IV.
   (b)    This Program will be located at various locations throughout the municipality. The duration of crack sealing under this Program will be determined by the Director of Public Service but shall take place sometime between early June and mid-September and will take several weeks to complete.
   (c)    That each road and section be its own separate line item in the bidding process paid on a ‘Lump Sum’ basis and shall follow the following example or similar format as shown below:

   (d)    The price bid for each item cover and shall be considered full compensation for the furnishing of all labor, materials, equipment, and incidentals necessary to complete all proposed work, as set forth in the details and specifications and shall include but not limited to:
      (1)    All labor, materials, tools, equipment, and transportation necessary for the proper execution of the work in accordance with the contract documents and as necessary to comply with local, state, and federal codes.
      (2)    Project coordination and scheduling.
      (3)    All provisions to protect workers, the general public, and property along the work area.
      (4)    Reimbursement to City for costs of re-inspection or re-testing of any work not installed in compliance with the contract documents.
      (5)    Maintenance of traffic.
      (6)    Mobilization/Demobilization.
      (7)    Bonds and Insurances.
      (8)    Any and all cleaning, joint sealing, etc.
   (e)    That beginning January 1, 2023, and continuing thereafter, the Program shall be funded using revenue generated by the City’s Street Construction Fund. The Program shall be funded in the amount of two hundred thousand dollars ($200,000.00) each calendar year subject to revision by City Council in accordance with this section.
      (1)    Each year of this Programs existence, City streets shall be crack sealed as determined from the results of previous inspections, as set forth in Section 903.01 of this code.
      (2)    That this program be presented as part of the annual budget process.
      (3)   Should the revenue fail to reach the amount allocated for the Program in any given year, City Council shall conduct a review of the Program funding to determine the funding source(s) for that year.
   (f)   The award of this program will be determined through an evaluation of bids submitted through the City’s competitive bidding process.
