143.01 FIRE CHIEF AND ACTING FIRE CHIEF.
   (a)   The Fire Department shall, as authorized by Section 8.04 of the City Charter, consist of a Fire Chief who shall be the chief administrative officer and supervisor of the Department. The Fire Chief shall be appointed by the Director of Public Safety in accordance with the civil service laws, from those individuals eligible for that position either from within or outside the Fire Department. Such person holding the position of Fire Chief at the time of this enactment shall be deemed qualified for that position under the civil service provisions of the Charter. Within six months after the completion of the one-year probationary period, the person holding the rank of Fire Chief shall become a resident of the City and remain for so long as he shall hold the full-time position.

   (b)   Pursuant to Sections 4.18 and 12.01 of the City Charter, there is established the full-time nonclassified position of Acting Fire Chief, which shall be utilized at such times as there is a vacancy in the position of Fire Chief. The Mayor shall have the authority to appoint any full-time officer of the Fire Department to this office at such time as no permanent Fire Chief, is in office, and until a permanent Fire Chief is appointed. While the fire officer fulfills the position of Acting Fire Chief, he shall have all the duties, responsibilities and powers of the Chief and shall receive a salary established and approved by Council.
