A person seeking issuance of a parade permit shall file an application with the Town Manager on forms provided by the town.
(A) Filing period. An application for a parade permit shall be filed with the Town Manager not less than 96 hours, excluding weekends, before the time when it is proposed to conduct the parade; provided, however, that, a permit may be issued if filed less than 96 hours before the time for commencement of the parade when the Town Manager finds that there is no conflict in schedule with some other event and that the time for filing is sufficient to prepare for the parade pursuant to the standards set forth under § 90.53 of this chapter.
(B) Contents. The application for a parade permit shall set forth the following information:
(1) The name, address and telephone number of the person seeking to conduct such parade;
(2) If the parade is proposed to be conducted for, on behalf of or by an organization, the name, address and telephone number of the headquarters of the organization, and of the authorized and responsible heads of such organization;
(3) The name, address and telephone number of the person who will be the parade chairperson and who will be responsible for its conduct;
(4) The date when the parade is to be conducted and the hours when such parade will start and terminate;
(5) The proposed route to be traveled, the starting point and the termination point;
(6) The approximate number of persons who, and animals and vehicles which, will constitute such parade; the type of animals and description of the vehicles;
(7) The location by streets and designation by time of an assembly area of such parade;
(8) If the parade is designed to be held by, and on behalf of, or for any person other than the applicant, the applicant for such permit shall file with the Town Manager a communication in writing from the person proposing to hold the parade, authorizing the applicant to apply for the permit in his or her behalf;
(9) The person or persons to be in charge of the activity and who will accompany it and carry the permit at all times; and
(10) Any additional information which the Town Manager shall find reasonably necessary to a fair determination as to whether a permit should be issued.
(C) Compliance. Before granting a permit pursuant to this section, the Administrator shall determine that the applicant has made arrangements to comply with division (B) above and, if the town is to do the necessary repair work, the permit shall not be issued until the applicant makes a deposit equal to the estimated costs of repair.
(D) Application. This section shall not apply to any utility to the extent that the same subject matter is covered in a franchise ordinance applicable to that utility. Nor shall this section apply to any excavation made in a state-maintained street to the extent that the state has given its permission for such an excavation to be made; except that, the person making the excavation shall still be responsible for notifying the Administrator of the intended excavation 48 hours before the work begins.
