(A) Prior to issuing real estate tax stamps upon for the sale of any vacant land, single-family residence, multiple-family residence, business, commercial or industrial building within the village, the owner thereof shall be required to obtain a certificate of compliance from the village.
(B) A certificate of compliance shall be issued by the village after an inspection by the Building Commissioner or by a lawfully appointed deputy of the Building Commissioner. The certificate shall set forth the finding of the Commissioner, or his or her deputy, that the property inspected either complies with all of the building, zoning, health and safety regulations of the village or, in the alternative, list the violations thereof.
(C) Upon receiving a copy of an inspection report from the village, in the event there are violations on the premises, the property’s owner-seller shall represent to the village, in writing, the seller’s intention to correct the violations and the time period necessitated for the correction thereof. In the alternative, the purchasers of the property may represent to the village the purchasers’ intention to correct the violation and the time period necessitated to do so. In either event, the time period for the correction of any violations set forth shall be reasonable with regard to those items detailed to be violations. As a condition before issuing transfer stamps for the sale of property, the village can require the seller to place funds in an escrow account to ensure that the violations are corrected. The funds shall be equal to one and one-half times the estimated cost of the corrections, unless the Building Inspector determines that a lesser amount will be sufficient. The funds shall be held by the village until the violations are corrected.
(D) Any inspection made by the Commissioner or a deputy shall bear inspection fees as follows:
(1) Vacant land: $25;
(2) Single-family residence: $75;
(3) Multi-unit residential structure (apartment, hotel or motel): $50 for first unit, plus $50 for each additional unit;
(4) Commercial and industrial structures: $200 for buildings or units up to 2,000 square feet, plus $75 for each additional 1,000 square feet; and
(5) Parking lot: $25.
(E) Where this section pertains to the sale of property, it shall apply to any person either participating in the sale as owner, agent or representative of the owner receiving a sales commission in connection with the sale.
(F) The inspection of any building pursuant to the terms of this section by the Building Commissioner or deputy is for the purposes of the village only; the results of the inspection are not to be construed as a representation of any person of the condition of the same, nor relied upon by any persons for any purpose other than those of the village.
