§ 114.01 DEFINITIONS.
   For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   INDECENCY. Nudity, exposure of breasts, exposure of the genital area, dress which does not fully cover genitals, lewd or indecent gestures or any other activity constituting a lewd, filthy or indecent act.
   MATERIAL HARMFUL TO MINORS.
      (1)   Material which the average person, applying contemporary standards, has as its predominant appeal, when taken as a whole, an appeal to prurient interest, that is, shameful or morbid interest in nudity, sex or excretion, which goes substantially beyond customary limits of candor in description or representation of those matters, and is material the redeeming social value of which is substantially less than its prurient appeal.
      (2)   Material which displays nudity, exposed breasts or the genital area of a person or which contains a message that it is for adult reading or view is prima facie MATERIAL HARMFUL TO MINORS.
   OBSCENITY. Acts, words or materials which, if considered as a whole, appeal predominantly to prurient interests, that is, a shameful or morbid interest in nudity, sex or excretion, and which goes substantially beyond the customary limits of candor in description or representation of those matters; materials the redeeming social importance of which is substantially less than its prurient appeal.
   PUBLIC PLACE. Any location where persons congregate, whether admission is charged or not; any place open to the public, generally.
