§ 96.16 FENCES.
   No person shall erect, construct or maintain any fence or any section or portion thereof unless it shall conform to the following requirements and specifications.
   (A)   On that portion of the premises within 35 feet of the property line fronting a public street, all fences shall be at least 50% open and no fence shall exceed four feet in height above the surface of the ground.
   (B)   On that portion of the premises which is more than 35 feet from the property line fronting a public street and which is more than five feet from the property line abutting a public alley, and which is less than ten feet from any adjacent private property, no fence shall exceed five feet, four inches in height above the surface of the ground unless first there shall be filed with the Village Clerk a consent in writing signed by the owner of record of the nearest private property contiguous thereto, which consent may authorize a particular fence not exceeding, in any event, seven feet above the surface of the ground.
   (C)   On that portion of the premises which constitutes the rear and which abuts on a public alley, and which is not more than five feet from the property line abutting the public alley, no fence may exceed a height of seven feet above the surface of the ground but may be constructed of any material, excepting barbed wire, as desired by the owner or occupant of the premises.
   (D)   (1)   No person being the owner, lessee or agent of any real estate in the village shall erect, maintain or permit to be erected or maintained on or about the exterior building line of the real estate or upon any portion of the sidewalk adjacent to the real estate any railing, fence, guard or protection of any kind of barbed wire or upon which railing, fence, guard or other protection there shall be affixed or placed or in any manner attached any spike, nail or pointed instrument of any kind or description.
      (2)   Not more than three strands of barbed wire shall be permitted along the uppermost portion of fences about the exterior building line of the real estate or upon any portion of the sidewalk adjacent to the real estate of all parcels of real estate classified as commercial district B and industrial district under the provisions of the Stone Park Zoning Ordinance of 1940 as amended, provided the strands of barbed wire shall be at least six feet above the sidewalk and extend inward of the property.
