6-2-4: OPERATION REGULATIONS:
   A.   Switchyards: The switchyards of the Town shall be defined as follows: starting at north end of Stockton Bar and ending south end of Stockton Bar; starting south of the Silver Avenue armed crossing and ending approximately one-half (1/2) block south of Silver Avenue.
   B.   Warning Signals On Gates Required:
      1.   All railroads passing through any part of the Town who maintain safety at the intersection of their respective right- of-way with any public highway in the Town at grade crossings shall equip all the gates with electric lights or warning signals of sufficient power and intensity to warn approaching vehicles or pedestrians that the gates are closed.
      2.   All railroads operating in the Town and having or using a railroad crossing in the Town are hereby required to maintain in continuous and proper working condition all grade crossing equipment and safety devices so as not to unnecessarily impede or adversely affect traffic or adversely affect the health and welfare of the community.
      3.   All railroads operating in the Town and having or using a railroad crossing shall be required to install all crossing equipment as required by the Department of Transportation.
   C.   Restrictions On Traffic; Exception:
      1.   Railroad traffic shall not obstruct, block or otherwise impede vehicular traffic on any crossing within the Town during any hours, except as provided herein.
      2.   Prohibited railroad traffic shall include, but not be limited to, the following:
         a.   Traffic originating outside of and moving into the Town utilizing public streets for this movement with the hours set forth in this section, when the traffic shall have as its next destination or stopping point a point outside of the Town.
         b.   Traffic originating outside of and moving into the Town utilizing public streets for this movement within the hours set forth in this section, when the traffic shall have its next destination or stopping point a point inside of the Town.
         c.   Traffic originating within the Town to any other point within the Town over any public street or railroad crossing within the Town within the hours set forth in this section.
         d.   Traffic originating inside of and moving outside of the Town utilizing public streets for this movement with the hours set forth in this section, when the traffic shall have as its next destination or stopping point a point outside of the Town.
      3.   Subsection C1 of this section shall not apply to those specific railroad trains carrying passengers for hire and operating as interstate or intrastate common carriers.
   D.   Lights Required: Every locomotive engine, railroad car or train of cars, running in the nighttime on any railroad track in the Town, shall have and keep while so running a brilliant and conspicuous light on the forward end of the locomotive engine or train of cars, and in case any engine, car or train shall be run backward at that time, the light shall be kept at the rear end thereof.
   E.   Speed: Locomotive engines moving in a northerly or southerly direction on any railroad crossing in the Town shall not exceed a speed of forty five (45) miles per hour.
   F.   Watchman Required: It shall be unlawful for any railroad company, conductor, engineer or any other person managing any car, locomotive or train of cars to run the same backward in or through the Town without a watcher or other person on the rear end of the car, locomotive or train, or to shove any car in the Town by means of locomotive engine power without a watchman on the forward end of the car.
   G.   Standing Cars: It is unlawful for any railroad company or any person operating or having charge or control of any railroad train, railroad car or engine within the Town:
      1.   To permit, allow or cause any train, railroad car or engine to stand at any intersection of any street, sidewalk or alley, for a period longer than fifteen (15) minutes at any one (1) time, without allowing vehicles and pedestrians to cross the railroad tracks, except when necessary to comply with governmental safety regulations or where the train, railroad car or engine cannot be removed by reason of circumstances over which the railroad company has no control.
      2.   To obstruct any intersection of any street, sidewalk or alley for a period longer than fifteen (15) minutes at any one (1) time by switching, without allowing vehicles and pedestrians to cross the railroad tracks over any such street, sidewalk or alley, except when necessary to comply with governmental safety regulations or where the train, railroad car or engine cannot be removed by reason of circumstances over which the railroad company has no control.
      3.   This section shall not apply to trains, railroad cars or engines in motion, other than those engaged in switching.
      4.   This section is enacted to promote the public interest and welfare of the residents of the Town and those using its public streets and alleys, not to control railroad safety, thus its enactment shall not supplant current Utah law governing "negligence" or the lack thereof by railroads, their employees and/or agents at street, sidewalk and alleyway crossings.
   H.   Cattle Cars:
      1.   It shall be unlawful for any railroad company owning and controlling any railroad running through the Town or any person in their employ to permit cattle cars, which have been in recent use and are unclean, to stand on any siding or sidetrack within the Town for a longer period of four (4) hours.
      2.   It shall be unlawful for any person owning or controlling a railroad through the Town or persons in their employ to remove the straw manure from a cattle car and to clean the cars within the Town. (Ord. 07-01, 1-11-2007)
