The violation of any binding element, as defined herein, shall constitute a civil ofijense which may subject the violator to the penalties and processes allowed under KRS 100.401 through 100.417, which include a civil fine and/or other remedial orders of the Planning Commission, or the City of St. Matthews (if the Planning Commission appoints a City of (St. Matthews Local Enforcement Officer), in accordance with procedures set forth in this subchapter.
