§ 31.17 ALCOHOLIC BEVERAGE CONTROL ADMINISTRATOR.
   (A)   There is hereby created the office of City Alcoholic Beverage Control Administrator, to be known as the city “ABC Administrator” or “Alcoholic Beverage Control Administrator.”
   (B)   The city ABC Administrator shall be appointed by the mayor subject to the approval of the city council.
   (C)   The person appointed the city's ABC Administrator shall be a minimum of 30 years of age, of good moral character, and shall have those qualifications prescribed by KRS 241.100.
   (D)   Before entering upon his or her duties of office, he or she shall:
      (1)   Take the Oath prescribed by Section 228 of the Kentucky Constitution;
      (2)   Execute bond with good corporate surety in the penal sum of not less than $1,000.
   (E)   The functions of City ABC Administrator shall be the same with respect to city licenses and regulations as the functions of the county board with respect to state licenses and regulations, except that no regulation by a city ABC Administrator may be less stringent than the states relating to alcoholic beverage control board or the regulations of the board.
   (F)   The city council finds that an emergency exists with respect to the adoption and implementation of this section and the appointment of a city ABC Administrator due to the fact that this is the last meeting of the city council prior to the expiration date of all city alcohol licenses and the renewal thereof and the city needs a person in place to handle those licenses.
