§ 70.01 DEFINITIONS.
   For the purpose of this traffic code the following words and phrases shall have the following meanings ascribed to them respectively.
   "ABANDONED VEHICLE." Any automobile which is left upon the right- of-way of a state highway for 3 consecutive days, whether or not it is fit for future use.

   "ALL-TERRAIN VEHICLE." Any motor vehicle for off-road use, which is 50 inches or less in width; has a dry weight of 600 pounds or less; travels on three or more low pressure tires; is designed for operator use only with no passengers; and has a seat or a saddle designed to be straddled by the operator, and handle bars for steering control.
   "AUTHORIZED EMERGENCY VEHICLE." Any vehicle within the following classification.
      (1)   "EMERGENCY VEHICLE." Any vehicle used for emergency purposes by
         (a)   The Department of Kentucky State Police;
         (b)   A public police department;
         (c)   The Department of Corrections;
         (d)   A sheriff's office;
         (e)   A rescue squad;
         (f)   An emergency management agency if it is a publicly owned vehicle;
         (g)   A licensed ambulance service, mobile integrated healthcare program, or medical first-response provider licensed by the Kentucky Board of Emergency Medical Services, for any vehicle used to respond to emergencies or to transport a patient with a critical medical condition;
         (h)   Any vehicle commandeered by a police officer;
         (i)   Any vehicle vehicle with the emergency lights required under KRS 189.920 used by a paid or volunteer fireman or paid or volunteer ambulance personnel, or a paid or local emergency management director while responding to an emergency or to a location where an emergency vehicle is on emergency call;
         (j)   An elected coroner granted permission to equip a publicly or privately owned motor vehicle with lights and siren pursuant to KRS 189.920;
         (k)   A deputy coroner granted permission to equip a publicly or privately owned motor vehicle with lights and siren pursuant to KRS 189.920;
         (l)   Any vehicle used by an organ procurement organization while transporting a human organ or tissue for the purpose of organ recovery or transplantation in an emergency situation involving an imminent health risk; or
         (m)   A conservation officer of the Kentucky Department of Fish and Wildlife Resources.
      (2)   "PUBLIC SAFETY VEHICLE." Public utility repair vehicle; wreckers; state, county, or municipal service vehicles and equipment; highway equipment which performs work that requires stopping and standing or moving at slow speeds within the traveled portions of highways; and vehicles which are escorting wide-load or slow-moving trailers or trucks.    "BOAT." A rowboat, motorboat, or houseboat.
   "BUSINESS DISTRICT." The territory contiguous to and including a highway if, within 600 feet along the highway, there are buildings in use for business or industrial purposes that occupy 300 feet of frontage on one side or 300 feet collectively on both sides of the highway.

   "CENTER OF INTERSECTION." The point of intersection of the center line of the intersecting streets. Business and central traffic district shall include all commercially zoned area within the city limits.
   "COMMERCIAL DRIVER'S LICENSE." A license issued pursuant to KRS Chapter 281A.
   "COMMERCIAL VEHICLE." A motor vehicle designed or used for the transportation of merchandise, wares, or other material.
   "CROSSWALK."
      (1)   That part of the roadway at an intersection within the connections of the lateral lines of the sidewalks on opposite sides of the highway measured from the curbs or in the absence of curbs, from the edges of the traversable roadway; or
      (2)   Any portion of a roadway at an intersection or elsewhere distinctly indicated for pedestrian crossing by lines or other markings on the surface.
   "CRUISE." To drive or operate a taxicab or other vehicle for hire at a rate of speed of less than 10 miles per hour for the primary purpose and intention of obtaining or picking up a passenger.
   "CURB." The boundary of that portion of the street used for vehicles whether marked by curbstones or not.
   "DEPARTMENT." The Department of Highways.

   "DRIVER'S LICENSE." An operator's license issued pursuant to KRS 186.412.

   "HIGHWAY." Any public road, street, avenue, alley or boulevard, bridge, viaduct or trestle and the approaches to them and includes private residential roads and parking lots covered by an agreement under KRS 61.362, off-street parking facilities offered for public use, whether publicly or privately owned, except for hire parking facilities listed in KRS 189.700.

   "INTERSECTION."
      (1)   The area embraced within the prolongation or connection of the lateral curb lines, or, if none, then the lateral boundary lines of the roadways of 2 highways which join one another, but not necessarily continue, at approximately right angles, or the area within which vehicles traveling upon different highways joining at any other angle may come into conflict;
      (2)   Where a highway includes 2 roadways 30 feet or more apart, then every crossing of each roadway of such divided highway by an intersecting highway shall be regarded as a separate intersection. If the intersecting highway also includes 2 roadways 30 feet or more apart, every crossing of 2 roadways of the highways shall be regarded as a separate intersection. The junction of a private alley with a public street or highway shall not constitute an intersection.
   "LOADING ZONE." The roadway space adjacent to the curb reserved exclusively for the loading and unloading by vehicles of passengers and property.
   "MANUFACTURED HOME" has the same meaning as defined in KRS 186.650.
   "MOPED." A motorized bicycle whose frame design may include one or more horizontal crossbars supporting a fuel tank so long as it also has pedals, or a motorized bicycle with a step through type frame which may or may not have pedals rated no more than two brake horsepower, a cylinder capacity not exceeding 50 cubic centimeters, an automatic transmission not requiring clutching or shifting by the operator after the drive system is engaged, and capable of a maximum speed of not more than 30 miles per hour.

   "MOTOR BUS." Any motor vehicle designed primarily for the transportation of passengers and having a seating capacity in excess of 9 passengers including the driver.

   "MOTORCYCLE." Any motor driven vehicle having a seat or saddle for the use of the operator and designed to travel on not more than 3 wheels in contact with the ground, but excluding tractors and vehicles on which the operator and passengers ride in a enclosed cab and excluding a moped.

   "MOTOR TRUCK." Any motor propelled vehicle designed for carrying freight or merchandise. It shall not include self-propelled vehicles designed primarily for passenger transportation, but equipped with frames, racks or bodies having a load capacity of not exceeding 1,000 pounds.

   "MOTOR VEHICLE." Any vehicle propelled by an internal combustion engine capable of transporting persons or property, except a "MOPED" as defined herein.
   "OFFICIAL TRAFFIC CONTROL DEVICES." All signs, signals, marking, and devices placed or erected by authority of a public body or official having jurisdiction, for the purpose of regulating, warning, or dividing traffic.

   "OFF-ROAD VEHICLE." A motor vehicle capable of cross-county travel, without the benefit of a road or trail. It does not include a farm vehicle, a vehicle used for military or law enforcement purposes, a vehicle used in construction, mining, or other industrial related purposes, aircraft, or any other vehicle registered under state law.

   "ONE-WAY STREET." A street upon which vehicles are permitted to move in one direction only.
   "OPERATOR." The person in actual physical control of a vehicle.

   "OWNER." The last registered owner.
   "PARK." (when applied to vehicles) To leave a vehicle standing, whether occupied or not for a period of time longer than is necessary to receive or discharge passengers or property.
   "PEDESTRIAN." Any person afoot.
   "PLAY STREET." Any street or portion thereof so designated by the director of works and reserved as a play area for children, from which all traffic is debarred, except vehicles to and from abutting properties.
   "PUBLIC WAY." The entire width between property lines of every way, dedicated passway or street set aside for public travel, except bridle paths and foot paths.
   "REFLECTANCE." The ratio of the amount of total light, expressed in a percentage, which is reflected outward by the product or material to the amount of total light falling on the product or material.
   "RESIDENTIAL DISTRICT." The territory contiguous to and including a highway not comprising a business district if the property on the highway for a distance of 300 feet or more is improved with residences or residences and buildings in use for business.

   "REVERSE TURN." To turn a vehicle upon any street in such a manner as to proceed in the opposite direction.
   "RIGHT-OF-WAY." The right of one vehicle or pedestrian to proceed in a lawful manner in preference to another vehicle or pedestrian approaching under such circumstances of direction, speed, and proximity as to give rise to danger of collision unless one grants precedence to the other.
   "ROADWAY." That portion of any street, improved, designated or ordinarily used for vehicular travel, exclusive of the berm or shoulder. If a highway includes 2 or more separate roadways, the term "ROADWAY" as used herein shall refer to any roadway separately but not to all such roadways collectively.
   "SAFETY ZONE." The area or space officially set apart within a roadway for the exclusive use of pedestrians and which is protected or is so marked or indicated by adequate signs as to be plainly visible at all times while set apart as a safety zone.
   "SECRETARY." The secretary of the department of transportation.
   "SEMITRAILER." A vehicle designed to be attached to, and having its front end supported by, a motor truck or truck tractor, intended for the carrying of freight or merchandise and having a load capacity of over 1,000 pounds.

   "SHARP CURVE." A curve of not less than 30°.

   "SIDE." That portion of the street between the curb and the property line intended for the use of pedestrians.
   "SLOW-MOVING VEHICLE." Includes farm machinery, including animal drawn vehicles, highway construction and maintenance vehicles, and any other type of vehicle except bicycles and electric low-speed scooters, capable of a rate of speed no greater than 25 m.p.h.

   "SLOW-MOVING VEHICLE EMBLEM." Consists of a fluorescent yellow- orange triangle with a dark red reflective border, as specified in American Society of Agricultural Engineers R276 or Society of Automotive Engineers J943 standards, or consisting of reasonably similar reflective qualities as specified in the standards.

   "STATE POLICE." Any agency for the enforcement of the highway laws established pursuant to law.

   "STATE HIGHWAY." A highway or street maintained by the Kentucky Department of Highways.

   "STEEP GRADE." A grade of exceeding 7%.

   "STOPPING." (as applied to vehicles) To stop a vehicle longer than is actually necessary to receive or discharge passengers.
   "STREET." Every public way including alleys.
   "STREET LINE." A line separating a street from the lots abutting thereon.
   "SUNSCREENING MATERIAL." A product or material, including film, glazing, and perforated sunscreening, which, when applied to the windshield or windows of a motor vehicle, reduces the effects of the sun with respect to light reflectance or transmittance.

   "TAXICAB." A public motor vehicle licensed as a taxicab, including vehicles for hire, designated to carry 7 or less persons, except funeral cars and "drive yourself" autos.
   "TRAFFIC." Pedestrians, ridden or herded animals, vehicles, buses and other conveyances, individually or collectively, while using any street for the purpose of travel.
   "TRAILER." Any vehicle designed to be drawn by a motor truck or truck tractor, but supported wholly upon its own wheels, intended for the carriage of freight or merchandise, and having a load capacity of over 1,000 pounds.

   "TRANSMITTANCE." The ratio of the amount of total light, expressed in a percentage, which is allowed to pass through the products or material, including glazing, to the amount of total light falling on the product or material and the glazing.

   "TRUCK TRACTOR." Any motor propelled vehicle designed to draw and to support the front end of a semitrailer. The semitrailer and the truck tractor shall be considered to be one unit.

   "UNOBSTRUCTED HIGHWAY." A straight, level, first class road upon which no other vehicle is passing or attempting to pass, and upon which no other vehicle or pedestrian is approaching in the opposite direction, closer than 300 yards.
(KRS 189.010 (18))
   "VEHICLE." Includes all agencies for the transportation of persons or property over or upon the public highways of the commonwealth, all vehicles passing over or upon the highways, and all vehicles propelled by power other than muscular power. “VEHICLE” does not include road rollers, road graders, farm tractors, vehicles on which power shovels are mounted, construction equipment customarily used only on the site of construction and which is not practical for the transportation of persons or property upon the highways, vehicles that travel exclusively upon rails, and vehicles propelled by electric power obtained from overhead wires while being operated within the municipality or where the vehicles do not travel more than 5 miles beyond the city limits and electric low-speed scooters.

   "WINDOW." Any device designed for exterior viewing from a motor vehicle, except the windshield, any roof-mounted viewing device, and any viewing device having less than 150 square inches in area.

   "WRECKER." A motor vehicle on which a wrecking crane and other equipment suitable for motor vehicle wrecker service has been permanently mounted.
