(a) The Tree Commission shall have the authority to regulate the planting, trimming and removal of trees on Municipal public property, by any person, within the corporate boundaries in the City of St. Marys. Council shall have the right to review the conduct, acts and decisions of the City Tree Commission. Any person may appeal from any ruling or order of the City Tree Commission to Council who may hear the matter and make final decision.
(b) Any person within said corporate boundaries desiring to plant, trim or remove a tree on municipal public property shall first secure permission from said Tree Commission, in writing, and if necessary, shall execute a waiver of responsibility.
(c) Any person violating this section shall be guilty of a misdemeanor and shall be fined by the proper municipal authority not in excess of one hundred dollars ($100.00).
