§ 35.20 DEFINITIONS.
   For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   ASSESSABLE COSTS. Those costs for services incurred by the city in connection to a response by the Public Safety Department to a purported emergency incident or other covered event. The costs will be determined using actual costs as measurement. Based on an evaluation of actual costs, a flat fee will be administratively determined and included in the city's rate and fee schedule. This fee will be subject to adjustment as labor, material, inflation and other relevant costs fluctuate.
   EMERGENCY ASSISTANCE. Emergency medical, public safety, police, fire and civil defense services, to include responses to events involving motor vehicles.
   EXCESSIVE REQUESTS FOR EMERGENCY ASSISTANCE. Any request for emergency assistance made to a particular location or premises if such location or premises has requested emergency assistance more than 3 times in the preceding 30 days.
   FALSE ALARM. Any automated or manual device designated to request or summon emergency assistance whether such device is activated intentionally or otherwise, in the absence of an actual need for emergency assistance. What constitutes a FALSE ALARM as opposed to an actual emergency shall be determined by the on-scene commander or supervisor of the event or incident which caused the response. A FALSE ALARM will not be considered as an assessable cost under this subchapter until a second such occurrence has issued from the same premises, business or location during the preceding 6-month period.
   FIRE RUN. Any response by the City Fire Department to a dispatched request for service as relates to a structure, premises or motor vehicle, to include trailers or appurtenances attached to a motor vehicle.
   MUTUAL AID AGREEMENT EVENT. Assistance provided by the City Fire Department to a requesting governmental entity outside of the physical boundaries of the City of St. Johns. A mutual aid event under this subchapter is limited to assistance provided to a requesting governmental entity that is a party to the Mutual Aid Agreement of which the City of St. Johns is a signatory. See § 35.22.
   RESPONSIBLE PARTY. Any individual, business, firm, corporation, association, partnership, commercial entity, joint venture, or other legal entity responsible for a public safety incident, fire run or other covered incident or event. RESPONSIBLE PARTY also means any owner, tenant, occupant, or party in control of real and/or personal property from which, onto which, or related to there is a Public Safety or Fire incident or event. Furthermore, RESPONSIBLE PARTY includes heirs, estates, successors in interest and assigns of the entities above-described.
