7-2-3: NOTICE TO CONSTRUCT:
Whenever the city council shall order the construction, reconstruction or repair of any sidewalk, under the provisions of this chapter, it shall give to the owners of the proper which may be assessed therefor, a notice stating that unless within fifteen (15) days after the service of such notice upon them, such owner or owners shall commence the construction, reconstruction or repair of such sidewalk and shall complete the same within thirty (30) days thereafter which is specified in said notice, the city council will proceed as hereinafter provided, to construct, reconstruct or repair the same, and tax the cost thereof to the property abutting thereon as by law provided 1 . The notice herein provided for shall be substantially as follows:
   NOTICE
   To
   Notice is hereby given that the city council of the city of Steamboat Rock, Iowa, on the         day of                , 20     , ordered a permanent sidewalk (specifying whether to be constructed, reconstructed or repaired) in        days from that date, on the        side of        street, between        and        streets, in front of the following described premises: (giving number of lot and block, or description of said tract of land), in said city, to be the width of        feet, and        feet from the property line, constructed in the manner required by the city.
   You are further notified that unless the same be (specifying whether to be constructed, reconstructed or repaired) within the time and in the manner required, the said city council will cause such sidewalk to be (specifying whether constructed, reconstructed or repaired) and so much of the cost thereof will be assessed against the premises chargeable therewith as shall equal the special benefit thereto.
   Dated at Steamboat Rock, Iowa, on this the        day of         , 20    .

Said notice shall be served on the owner of each lot or parcel of land fronting or abutting upon the contemplated improvement when said owner can be found, and in case he cannot be found within the city, then upon the agent for said property, if any such agent is found within the city. The officer serving the notice shall make due return of the service and the notice, and the same shall be filed by the city clerk and by him preserved among the records of the city, and if the officer has returned that no one can be found upon whom service can be made, then publication of such notice shall be by posting in three (3) public places in the city. Any notices that must be served under the provisions of this chapter or any other provisions of this code, now in force or hereafter enacted, may be served by the mayor, city clerk, any member of the city council, or any other person that may be designated by the city council, and a return made by the officer or person serving the same, by merely signing the same.
