A. Removal: The tenant or occupant, or in case there shall be no tenant or occupant, the owner or owners of any building or lot or tract of land fronting on or bordering on any street where there is a sidewalk in front thereof, shall, after the ceasing to fall of any snow thereon, remove or cause to be removed, the snow or ice therefrom, within twelve (12) hours after the said snow may have ceased to fall or the ice to form on said sidewalk, and shall keep or cause said sidewalk or walks to be kept clear of snow and ice as herein provided. B. Debris And Obstacles: All tenants or occupants of premises shall at all times ensure that all debris and any other obstacles or encroaching vegetation is removed from the sidewalks in order to keep said sidewalks in a clear and clean condition. (2004 Code)
C. Removal By City: Upon the failure of the tenant, occupant or the owner to remove or cause to be removed, the snow or ice hereinbefore referred to in subsection A of this section, within the time provided therein, said snow or ice may be removed under the direction of the mayor without notice to the tenant, occupant or owner of said premises, at the expense of the city, and the city council shall assess the cost thereof to the lot, lots or tract of land in front of or abutting upon the sidewalk from which said snow or ice may have been removed, provided the amount assessed against said abutting land shall be ten cents ($0.10) per square foot of walk shoveled, the amount to be so assessed and taxed shall be a lien upon the lot or tract of land from the time of the adoption of the resolution by the city council as herein provided. D. Duties Of City Clerk: The city clerk shall make each month to the city council an accurate itemized report of the sidewalk or walks from which snow or ice was removed by the city, the date of such removal, and the cost thereof, and the description of the lot or tract of land abutting upon the sidewalk from which snow or ice was so removed, the name of the person to be paid for doing such work, and all other facts material to a correct understanding of what has been done under this chapter, and said report shall be presumptive evidence of the facts therein stated. E. Assessment By City Council: At the next regular meeting of the city council after the report is made by the city clerk as provided in subsection C of this section, the city council shall by resolution, assess the cost of removing the snow and ice from the sidewalks as herein provided, against the lots or tracts of land from which said snow or ice was removed, and said assessment shall be certified by the city clerk to the county auditor of Hardin County, to be collected by the county treasurer in the same manner as other taxes.
