7-1-3: TRIMMING OF SHADE TREES:
The abutting property owner shall not permit the branches of any trees upon or adjacent to any street or alley in the city to hang less than eight feet (8') above the ground, except young trees less than three inches (3") in diameter, nor so as to prevent the proper lighting of a street or alley, and in case of a failure of the abutting property owner, upon notice to do so, to trim the trees upon or adjacent to any street or alley, it shall be the duty of the mayor to cause them to be trimmed so as to comply with the provisions of this chapter, and the expense thereof shall be assessed against the abutting property by the city council, and collected in the same manner that other special assessments are levied and collected, or the said expense may be collected by an action brought in the name of the city, in any court of competent jurisdiction.
