(A) General. This term includes, but is not limited to, the following materials:
(1) Diluents and adulterants, such as quinine hydrochloride, mannitol, mannite, dextrose and lactose which are used, intended for use or designed for use in cutting controlled substances;
(2) Separation gins and sifters used, intended for use or designed for use in removing twigs and seeds from, or in otherwise cleaning or refining, marijuana;
(3) Hypodermic syringes, needles and other objects used, intended for use and designed for use in parenterally injecting controlled substances into the human body; and
(4) Objects used, intended for use or designed for use in ingesting, inhaling or otherwise introducing marijuana, cocaine, hashish or hashish oil into the human body, which shall include, but is not limited to, the following:
(a) Metal, wooden, acrylic, glass, stone, plastic or ceramic pipes with or without screens, permanent screens, hashish heads or punctured metal bowls;
(b) Water pipes;
(c) Carburetion tubes and devices;
(d) Smoking and carburetion masks;
(e) Roach clips, meaning objects used to hold burning material, such as a marijuana cigarette, which has become too small or too short to be held in the hand;
(f) Miniature cocaine spoons and cocaine vials;
(g) Chamber pipes;
(h) Carburetor pipes;
(i) Electric pipes;
(j) Air-driven pipes;
(k) Chillums;
(l) Bongs; and
(m) Ice pipes or chillers.
(B) Possession prohibited. Possession, actual or constructive, of drug paraphernalia with the intent to inject, ingest, inhale or otherwise introduce a controlled substance into a human body is hereby prohibited.
(C) Permit for possession. Any person may seek a permit for the possession of specified items as drug paraphernalia. Such permits shall be issued by the Chief of Police on the following grounds:
(1) Historic, scientific or cultural significance;
(2) Medical or veterinarian purposes not contained within division (D) below or within the exception of § 133.04 of this chapter; or
(3) Other legal purposes not specified herein.
(D) Certain persons exempt. The provisions of this section shall not apply to the following in the ordinary course of their trade, business, profession or condition:
(1) Dealers in surgical instruments;
(2) Apothecaries;
(3) Physicians;
(4) Dentists;
(5) Veterinarians;
(6) Nurses;
(7) Attendants and interns of hospitals, sanatoria or any other institution in which persons or animals are treated for disability or disease;
(8) Public officers or employees whose official duties require possession or control of drug paraphernalia, or persons aiding such officers or employees in the performance of such duties;
(9) Persons who use drug paraphernalia for farming, livestock or other agricultural purposes; or
(10) Diabetics and other persons using drug paraphernalia under the guidance and supervision of a licensed physician or dentist.
