ADOPTING ORDINANCE
ORDINANCE NO. 006-03
AN ORDINANCE OF THE TOWN OF STAR VALLEY, ARIZONA, ADOPTING THE TOWN OF STAR VALLEY TOWN CODE BY REFERENCE; FIXING THE EFFECTIVE DATE; PROVIDING FOR SEVERABILITY; ESTABLISHING PENALTIES FOR THE VIOLATION THEREOF; AND DECLARING AN EMERGENCY.
   WHEREAS, it is necessary and desirable for the health, safety and welfare of the residents of the Town of Star Valley that a town code be adopted that provides for the governance of the Town; and
   WHEREAS, it is necessary to provide for the usual daily operation of the municipality and for the immediate preservation of the public peace, health, safety and general welfare of the municipality that this ordinance take effect at an early date.
   NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE TOWN OF STAR VALLEY, ARIZONA:
   Section 1: That certain document known as the "Town of Star Valley Town Code", three copies of which are on file in the office of the town clerk of the Town of Star Valley, Arizona, which document was made a public record by Resolution No. R006-11 of the Town of Star Valley, Arizona, is hereby referred to, adopted and made a part hereof as if fully set out in this ordinance.
   Section 2: The provisions of this ordinance and the Town Code adopted pursuant to this ordinance shall become effective from and after thirty days from the date of the adoption of this Ordinance.
   Section 3: If any section, subsection, sentence, clause, phrase or portion of this ordinance or any part of the Town Code adopted herein by reference is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions thereof.
   Section 4: Any person found guilty of violating any provision of this Ordinance shall be guilty of a class one misdemeanor. Each day that a violation continues shall be a separate offense punishable as herein above described.
   Section 5: The immediate operation of the provision of the ordinance is necessary for the preservations of the public health, safety and welfare of the community and an emergency is hereby declared to exist, and this Ordinance will be in full force and effect from and after passage and adoption by the Mayor and Council.
   PASSED AND ADOPTED by the Mayor and Council of the Town of STAR VALLEY, Arizona, this 18th day of July, 2006.
