No tree shall be planted, or an existing tree maintained at or near an intersection that does not permit a clear view down the side street or alley for a distance of 100 feet from the intersection measured along the curb. Any person or persons owning or occupying real property abutting on any street upon whose property there may be trees shall prune those trees in such a manner that they will not obstruct or shade the street lights, obstruct the passage of pedestrians on sidewalks, obstruct vision of traffic signs or obstruct the view of any street or alley intersection. The minimum clearance of any overhanging portion thereof shall be eight feet over sidewalks and fourteen feet over all streets. This section shall not be construed to require private property owners to prune, remove or otherwise maintain trees located on City-owned property or easements.
(a) Notice to Prune. Should any person or persons owning real property bordering on any street fail to prune trees as provided above, the City shall order such persons within thirty days after receipt of written notice to prune such trees.
(b) Order Required. The order required herein shall be served by mailing a copy of the order to the last known address of the property owner by certified mail.
(c) Failure to Comply. When a person to whom a lawful order, as provided above, is directed fails to comply with the terms thereof within the specified time, the City shall prune such trees, and the exact cost thereof shall be assessed to, and paid by the abutting property owner to whom such order was issued, provided that nothing herein contained is construed to require any person to cut, prune, remove or maintain any such trees or shrubs located on City-owned land or easements.
