Council may adopt a resolution directing the City Clerk to issue a permit authorizing a firing range upon receipt of the following:
(a) An application from a person, firm or corporation for a permit to use or operate a firing range which application shall be filed with the City Clerk and shall include:
(1) Information required.
A. The name of the applicant.
B. If such applicant is an incorporated association, the names and addresses of the members of its governing board.
C. If the applicant is a corporation, the names and addresses of its officers.
D. The place at which such applicant shall conduct the firing range whether the same is owned or leased by the applicant.
E. A statement as to the rules and regulations which shall be adopted by the applicant in regard to the safe operation of the firing range.
F. Such other information as Council may reasonably require which shall include, but not be limited to, the criminal records, if any, of the applicant, each member of the applicant's governing board and/or the applicant's officers and directors who have been convicted of a felony or a crime involving moral turpitude.
(2) Written approval by Police Chief. Written approval by the Chief of Police, which written approval shall be issued upon a reasonable showing to the Chief of Police that the operation of the firing range shall be properly supervised and shall not constitute a danger to life and property.
(3) Building permit; variance. A building permit indicating that the firing range is to be constructed as a permitted accessory use to a commercial establishment selling weapons in a C-1 General Commercial District or a variance by the Zoning Board of Adjustments authorizing the construction of a firing range in any other location permitted by the Zoning Ordinance of the City. In the case of a firing range to be situated in a previously constructed building, a certificate of occupancy issued by the Building Inspector may be substituted for a building permit or variance.
(4) Approval of plans and specifications. Written approval of the Building Inspector of the plans and specifications of the building in which the firing range is to be used or operated, which written approval shall be issued by the Building Inspector upon a reasonable showing that the building which is to be constructed or, in the case of an existing building, as constructed or as to be modified shall not constitute while in use a danger to life and property. In making this determination the Building Inspector shall consider but shall not be limited to the following conditions:
A. Ventilation.
B. Provisions for the storage of combustibles such as powder and bullets which shall not be stored in the basement.
C. The building shall be constructed in accordance with the Code requirements for a Group M-Mercantile structure as provided in the Building Code.
D. All firing ranges shall have two exits from all mercantile uses except on the first floor and if they are interior stairs they shall be enclosed. If there is to be only one exit, the plans in regard to exits shall be approved by the Board of Appeals as provided in the Building Code.
E. There shall be provisions to insure adequate building materials, width of walls and floors and insulation to prevent the escape of any bullet or projectile or the escape of noise.
(5) Approval of storage. Written approval by the Chief of the Fire Department or his designated representative, which written approval shall be issued upon a reasonable showing that the storage of powder and other explosives and the loading of projectiles shall not constitute a fire hazard or a danger to life and property.
(b) The approval of an application for a permit for the use of or operation of a firing range by Council shall be deemed to be discretionary.
