141.07 EMERGENCY RESPONSE FEE FOR NON-RESIDENTS.
   (a)   Response to Motor Vehicle Emergencies. In the event it is necessary for the Fire Department to respond to extinguish a fire or abate any other type of emergency, on or about any motor vehicle owned by a non-resident of the City of St. Albans, or any business entity not assessed a Unified City Service Fee under Section 954.01 of the St. Albans City Codified Ordinances, a fee of two hundred fifty dollars ($250.00) shall be assessed upon the owner of such vehicle. There shall be an additional fee of seventy-five dollars ($75.00) assessed upon such owner for each Fire Department apparatus remaining on the scene of the emergency after the first initial hour of emergency service. Said owner shall also be liable for, and the City shall reserve the right to recover from such owner, the cost and expense for the utilization of any specialized or disposable equipment or materials necessary to render an emergency scene safe and secure.
 
   (b)   Response to Emergencies Outside St. Albans Corporate Limits. In the event it is necessary for the Fire Department to respond outside the corporate City limits due to the inability or failure of the responsible Fire Department in that fire district to respond, the property owner shall be assessed two hundred fifty dollars ($250.00). Such owner of property requiring emergency service shall be liable for the cost and expense for the utilization of any specialized or disposable equipment or material necessary to render an emergency scene safe and secure. This will not be applicable when the St. Albans Fire Department is responding to a request for assistance consistent with approved mutual aid agreements.
 
   (c)   Specialized Emergency Service, Including But Not Limited to Water Rescue, Trench Rescue, High Angle Rescue or Hazardous Material Incidents. In the event it is necessary for the Fire Department to respond to any emergency including but not limited to Water Rescue and Recovery, Trench Rescue, High Angle Rescue or Hazardous Material incidents either inside or outside the corporate limits of the City of St. Albans, such owner or responsible party shall be subject to a fee of two hundred fifty dollars ($250.00) for the initial hour and one hundred dollars ($100.00) for each additional hour thereafter that the Fire Department remains on scene. Such owner or responsible party requiring emergency service shall be liable for the cost and expense for the utilization of any specialized or disposable equipment or material necessary to render an emergency scene safe and secure. An additional fee of twenty dollars ($20.00) per person, per hour shall be assessed to the owner or responsible party. (Ord. 2002-12. Passed 6-3-02.)
