Any person violating the provisions of this section is guilty of a felony as provided by State law, and, upon conviction thereof, shall be imprisoned in the penitentiary not less than one nor more than ten years, or, in the discretion of the Circuit Court, be confined in the County Jail not more than one year or fined not more than five hundred dollars, or both fined and imprisoned.
