(A) A swimming pool is any structure intended for swimming or recreational bathing that contains water over 24 inches deep. This includes in-ground, above ground and on-ground swimming pools; hot tubs; portable and non-portable spas; and fixed-in-place wading pools.
(B) A special purpose pool is any basin for holding water designed for human use, 100 square feet or less in water surface area. This definition includes but is not limited to treatment pools, therapeutic pools, whirlpools, spa pools, hot tubs and wading pools, and includes any portable version of these pools.
(C) A portable swimming pool is a shallow moveable unit, typically made of rubber or plastic and installed without permanent support and is 24 inches or less in depth. Portable pools are exempt from fencing requirements in § 154.03.
