§ 93.13 FIRE HYDRANTS, NONEMERGENCY.
   It shall be unlawful for any person, firm, or corporation to draw water from any city fire hydrant or other nonmetered source connected to the city water distribution system without first having obtained a temporary permit for the use of the hydrant or other source under the following terms and conditions:
   (A)   Applications for a fire hydrant use permit shall be made to the city secretary upon forms provided for the purpose which have been approved by the mayor. No permit shall be issued unless there is presented with the application a temporary water use permit issued by the Cincinnati Water Works.
   (B)   The only purpose for which a permit may issue for the use of fire hydrant or other nonmetered sources is the drawing of water for construction purposes. The original filling of both concrete and vinyl sand-treated swimming pools shall be considered a part of the project of the construction of the pool.
   (C)   Permits for the use of the fire hydrant and other nonmetered source shall be issued on a temporary basis and shall be effective for a period of one week or one month. The permit fee, which must be paid in advance, shall be $1 for one week, and $4 for a one-month permit. Permits shall be issued by the city secretary upon payment of the fee, provided all the conditions of this chapter are met and complied with.
   (D)   Upon the issuance of a permit the clerical assistant shall issue to the permit holder a spanner wrench suitable for opening and closing the hydrant valves and no wrench or tool other than the aforesaid spanner wrench may be used in opening and closing such valves. A deposit of $300 must be made with the clerical assistant to insure the return of the wrench by the permit holder and to indemnify the city against any damage to the fire hydrant. This deposit shall be returned to the permit holder upon the return of the wrench and the determination by the chief of the fire department or member of the department designated by the chief that no damage has been done to the hydrant. In the event of damage to the hydrant, the deposit shall be used to the extent necessary to repair the damage and the balance returned to the permit holder.
   (E)   With the issuance of each permit for the fire hydrant use there shall also be issued a colored tag, bearing the number of the fire hydrant use permit, the date of issuance, the time of duration of the permit, and the name of the permit holder, in form as prescribed by the mayor, which tag shall be attached to the hose attached to the fire hydrant or other source within 18 inches from the fittings with which the hose is so attached, and shall remain in place so long as the fire hydrant or other source is used for the purpose of drawing water.
   (F)   The city secretary shall forward to the office of the chief of the city fire department a copy of each fire hydrant use permit immediately upon the issuance of the permit. ('68 Code, § 28.30)
