§ 155.073 RESIDENTIAL MAXIMUM OCCUPANCY REGULATIONS.
   Standards for occupancy in all residential dwelling units shall be as follows:
   (A)   Occupancy Standards Based on Size of Residence. The City of Springdale limits the number of adult occupants in any residential dwelling unit based upon the finished square feet of the entire dwelling unit as determined by the Hamilton County auditor and/or municipal records on file at the Springdale Building Department. The following table outlines the limits for single-household dwellings and two-household dwellings.

In multi-household dwellings, the maximum number of adult occupants shall be calculated by dividing the finished square feet of each dwelling unit by 200.
   (B)   Occupancy standards based on bedrooms. The City of Springdale further limits the number of occupants in any residential dwelling unit based upon the size and number of bedrooms in the dwelling unit. For purposes of division (B) of this section, the term “occupant” shall include adults and children. The following table outlines the limits for single-household dwellings, two-household dwellings, and multi-household dwellings:

   (C)   The maximum number of occupants must conform to both division (A) and division (B). In the event that there is a conflict between division (A) and division (B) of this section with respect to the maximum number of occupants in any residential dwelling unit, the lower number of occupants shall be controlling.
   (D)   In addition to bedrooms as outlined above, each dwelling unit shall contain the following:
      (1)   A habitable room, other than a kitchen or bedroom, having a minimum floor area of 150 square feet and a minimum width of seven feet.
      (2)   A kitchen with a clear passageway of not less than three feet between counterfronts, counterfronts and appliances, or counterfronts and walls.
      (3)   A bathroom complying with § 155.080.
