(A) No person shall possess, sell or use any paint containing more than the amount of metallic lead specified in the standard "Preventing Lead Poisoning in Children," dated January 1985, as amended and promulgated by the U.S. Center for Disease Control.
(B) The Health Commissioner is charged with the duty of enforcing this section and may, upon presenting appropriate credentials, inspect any premises to ensure compliance. The Health Commissioner may issue any emergency or other order to abate any violation to any person responsible for abatement. Upon failure by such person to comply with such emergency or other order to abate, within the time specified for compliance in such order, the Health Commissioner may immediately take or cause to be taken whatever reasonable actions are necessary to abate the emergency or other health condition. The total cost of any abatement action taken by the Health commissioner may be collected by the City by civil action or certifying such costs, and all additional administrative cost of handling, together with a proper description of the property affected, to the County Auditor for placement on the tax duplicate.
