Whoever violates or fails to comply with any provision of this PMC or any remedial or abatement order issued pursuant thereto for which no other criminal penalty is provided is guilty of a misdemeanor of the fourth degree and shall be fined not more than $250 or imprisoned not more than 30 days or both. Each day of a continuing violation shall constitute a separate offense. A second conviction for the same offense within any 12 month period shall constitute a misdemeanor of the third degree and shall be punishable by a fine of not more than $500 or imprisonment not more than 60 days or both. A third conviction for the same offense within any 12 month period shall constitute a misdemeanor of the second degree and shall be punishable by a fine of not more than $750 or imprisonment not more than 90 days or both.
