(a) No person shall have in his or her possession any spirituous liquor, in excess of one quart, in one or more containers, which was not purchased at wholesale or retail from the Ohio Department of Liquor Control or otherwise lawfully acquired pursuant to Ohio R.C. Chapters 4301 and 4303, or any other intoxicating liquor, in one or more containers, which was not lawfully acquired pursuant to Ohio R.C. Chapters 4301 and 4303.

(b) Whoever violates this section is guilty of a misdemeanor of the fourth degree. Punishment shall be as provided in Section 698.02.
