§ 73.03 REGISTRATION; INSPECTION; FEES.
   (A)   Registration. All cart owners must complete a registration application and submit same to the town’s Police Department annually for approval. An approved certificate of registration and permit must be issued by the Chief of Police or his or her designee prior to operation of any cart upon a public roadway. A certificate of liability insurance for that particular cart must accompany the registration application stating an effective policy term for a 12-month period. Any person who operates a golf cart must be responsible for all liability associated with the operation of the golf cart and must have liability insurance coverage which will cover the use of a golf cart in an amount not less than required by state law for motor vehicles operated on public highways in the state. An operator of any cart shall have in his or her possession a valid certificate of registration, permit, valid certificate of insurance and a valid driver’s license to be presented to any officer upon request. All certificates of registration must be renewed annually and shall follow the town’s fiscal year (July 1 through June 30). Additionally, each operator must complete a disclaimer, liability waiver and assumption of risk releasing the town and the town’s Police Department from any liability that may arise as a result of operation of a golf cart inside the town prior to approval of the registration application.
   (B)   Inspection. All carts must meet the requirements and minimum standards of safety equipment as set forth in this chapter. The cart shall be inspected for approval by the Chief of Police or his or her designee prior to operation on public roadways. The Chief or his or her designee shall schedule such inspections at the Department’s convenience. Following inspection and payment of fees, if approved, the town shall issue a certificate of registration to the owner. This inspection shall be required annually prior to renewal of the owner’s certificate of registration. In the event a golf cart fails to pass the safety inspection and/or in the event a permit has been suspended due to failure to comply with safety equipment requirements set forth in this chapter, a re-inspection fee shall be paid prior to the re-inspection being performed. Such fee will be determined by the Town Board of Commissioners.
   (C)   Fees. A golf cart registration and inspection fee will be required for all golf carts. Fees for registration and inspection of carts shall be set annually by the town’s Board of Commissioners and shall be included in the town’s Schedule of Fees.
