§ 50.05 STORAGE AND COLLECTION.
   (A)   No person, other than those under the direction of the Public Works Director, shall haul away or remove any garbage or refuse set out for collection as provided in this chapter, except by written consent of the Public Works Director.
   (B)   Collection of garbage on a weekly basis by a predetermined route.
      (1)   All garbage containers shall be placed on the street no earlier than dusk on the evening prior to scheduled collection and no later than 7:00 a.m. on collection days. Containers shall be removed from the street and out of sight, where possible, by the owner or occupant of the premises by midnight on the day of collection. No containers of any type are to be placed, kept or left on the street for any purpose on Saturday and Sunday, except as provided for those with Monday pickups.
      (2)   Failure to abide by this policy will result in the following penalty: residents who place or leave their garbage containers and/or recycling bins on the street in violation of this policy shall receive a warning for the first offense. Second or future violations will result in a penalty pursuant to § 50.99.
   (C)   Preparation for collection of garbage. All counties and municipalities in North Carolina are required to institute recycling for the purpose of reducing the solid waste stream. In the city, garbage is to be separated for the purpose of collecting materials that can be recycled. Newspapers, aluminum and metal cans, plastic milk jugs and two- and three-liter soft drink bottles, glass bottles and jars, and other items as may be designated, are to be separated by the resident and brought to our convenience site at 600 Sowers Ferry Road. Site hours are from 7:00 a.m. to 3:30 p.m. Monday through Friday, and from 9:00 a.m. to 12:00 p.m. on the first and third Saturday of each month. Per G.S. § 130A-309.10, It is unlawful for any resident to place recyclables into regular garbage pickup.
   (D)   In residential areas all garbage must be in an approved 95-gallon roll out container. The maximum total garbage pickup per residence shall not exceed 190 gallons per week. One 95-gallon container will be provided by the town. If an extra 95-gallon container is needed the resident will be responsible for purchasing a second container from the town and will be billed at the town’s cost. Spillover litter, excess items or bags by receptacles, or any other condition declared a nuisance under § 93.21 shall be enforced accordingly as a violation of that section.
   (E)   Exemptions. Elderly, handicapped or other persons may be granted an exemption from curbside collection by the Public Works Director, for cause shown. Such persons will receive special collection service at a mutually determined site at the residence.
   (F)   Any variance in the collection method or schedule of garbage, trash, and the like, or the types of containers that are designated for collection must be approved in advance by the Public Works Director.
   (G)   Nothing except garbage shall be placed in garbage receptacles.
   (H)   Garbage receptacles as provided for in this chapter shall be placed on the curb or immediately adjacent to the street of the owner’s or tenant’s premises or in other designated areas as determined by the public works director, and made easily accessible to the collectors for emptying the receptacle. No garbage receptacles shall be placed in the streets.
   (I)   No person shall interfere with or remove the contents of any garbage receptacle set out for collection. Further, carts and bins supplied by the town are assigned to resident or business addresses, and are the property of the town. They are to be left at the address if the occupant moves to another location.
