§ 131.25 ENFORCEMENT PROCEDURES.
   (A)   A peace officer who has been appointed a truant officer by the school board, pursuant to Iowa Code §§ 299.10 and 299.11, may, without warrant, take into custody any apparently truant minor and place the minor in charge of the school principal or principal’s designee in the Spencer Community School District or, alternatively, the principal or principal’s designee of any non-public or parochial school in which the minor has been enrolled by his or her parent or guardian. If a minor is taken into custody pursuant to this section, the officer shall make a reasonable attempt to immediately notify the parent, guardian or other legal custodian of the minor’s location.
   (B)   The officer shall have discretion as to whether to issue a citation to the minor and/or the parent, guardian or other legal custodian.
   (C)   The provisions of this section do not authorize a peace officer to enter any dwelling or other building without a warrant.
