To provide emergency towing services within the City of Spencer a wrecker service must:
(a) Be licensed by and meet all requirements of the Public Service Commission of the State of West Virginia, Motor Carrier Division, for all vehicles, equipment, insurance and storage lots;
(b) Maintain in operable condition equipment which meets or exceeds all safety requirements set forth by the Public Service Commission;
(c) Maintain and keep current insurance which meets or exceeds the requirements of the West Virginia Public Service Commission and which includes the City of Spencer as an additional named insured;
(d) Keep operational in compliance with all applicable regulations, both a roll-back wrecker and a conventional hook-wrecker;
(e) Be available to respond 24 hours a day, 7 days per week, 365 days per year without major delays;
(f) Have the capacity to respond to the scene of an emergency within 15 minutes except in the case of heavy-duty wreckers which shall have the capacity to respond within 45 minutes;
(g) Shall maintain a storage facility that is sufficiently lighted, fenced and locked for protection of vehicles and property being towed;
(h) Shall keep all emergency towing vehicles equipped with tools and equipment sufficient to clear and remove all debris from accident scenes;
(i) Maintain a license to do business in the State of West Virginia and in the City of Spencer;
(j) Pay and keep current Business and Occupation taxes due the City of Spencer;
(k) Shall execute and file with the City of Spencer an emergency towing services agreement in the form attached hereto as Exhibit 1; and
(l) Individuals needing emergency towing services shall be charged a reasonable rate with no additional charge or surcharge for emergency services.
