No person shall:
(a) Drink from or possess any open container of alcoholic liquor or beer in or upon any street, alley, park (recreational facility), or other public place within the corporate limits of the City of Spencer.
(b) Any person found to be in violation of this section shall be fined not less than twenty-five dollars ($25.00) nor more than one hundred dollars ($100.00) and/or incarcerated for, or up to five days in the county jail.
