500.01 REGULATIONS REGARDING THE PERSONAL USE OF PYROTECHNIC DISPLAYS, COMMONLY REFERRED TO AS FIREWORKS.
   (a)    No private citizen shall discharge fireworks that explode or emit sounds such as shrieking, crackling, or popping loudly after 10:00 p.m. and before 8:00 a.m. on any given day of the year with exceptions for celebratory days listed under item (b).
   (b)    The hours for discharging fireworks are extended from 10:00 p.m. to 12:30 a.m. on New Year’s Eve and July 4th.
   (c)    All other regulations regarding pyrotechnic displays mirror those of the Title 103 Legislative Rule West Virginia Fire Marshal Series 4 “Regulation of Fireworks and Related Explosive Materials”.
   (d)    Whoever violates or fails to comply with any of the provisions of this article may be fined not more than one hundred dollars ($100.00) for each offense by the Municipal Court of Spencer, West Virginia. A separate offense shall be deemed committed each day during or on which a violation or noncompliance occurs or continues. Any applicable costs will be assessed in addition to fines for violating this article.
