§ 35.16 DEFINITIONS.

   For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.

   ARTWORK.

      (1)   Includes, but is not limited to, a sculpture, monument, mural, fresco, relief, painting, fountain, banner, mosaic, ceramic, weaving, carving and stained glass. ARTWORK would normally not include landscaping, paving, architectural ornamentation or signs; and   

      (2)   Has been, or is intended to be, displayed for more than two weeks:

         (a)   In an open city-owned facility or property;

         (b)   On the exterior of any city-owned facility;

         (c)   Inside any city-owned facility in areas designated as public areas;

         (d)   On any non-city property if the work is owned by the city, installed in whole or in part with city funds; or

         (e)   On any non-city property if the owner has applied for its placement on private property pursuant to §§ 35.25 and 35.26.

   CITY. The City of Spearfish.

   COMMERCIAL DEVELOPMENT. A discrete construction project other than an individual residential unit, a residential development or a public facility.

   COMMITTEE. The Art in Public Places Committee created and codified in § 35.18.

   CONSTRUCTION PROJECT. The construction, rehabilitation, renovation, remodeling, equipping or improvement of any building, street, park, utility line or other improvement, either private or for or by the city commenced after September 1, 2005, including all associated landscaping, parking and the like, but excluding any improvements excepted by the City Council after a public hearing thereon.

   INDIVIDUAL RESIDENTIAL UNIT. A discrete construction project resulting in not more than one single-family dwelling.

   PUBLIC FACILITY. A discrete construction project designed for use by the general public.

   RESIDENTIAL DEVELOPMENT. A discrete construction project other than an individual residential unit designed to be used primarily for human habitation, including two or more single-family dwellings being built concurrently in the same tract by the same owner or contractor.
