§ 153.072 PROTECTION OF PUBLIC AND SURROUNDING PROPERTIES.
   (A)   Any person receiving a permit to make excavations in or upon any street, alley, sidewalk or public ground shall, during the progress and continuance of the work, erect and maintain around the project area, both by day and night, suitable guards, fences, lanterns and signals so as to prevent injury to persons, animals or vehicles on account of such excavations. Such lanterns shall be kept lighted from sundown until sunrise. Traffic control will be determined by the City Engineer, based on the specific project and its proximity to roadways. If a traffic control plan is required, the contractor will be required to use State Department of Transportation (SDDOT) standard traffic control plates, which will be filed with the ROW permit application. Larger projects may require traffic control plans implemented by a SDDOT-approved contractor.
   (B)   It shall be unlawful for any person, owner or occupant of any lot to make or cause to be made any excavation adjacent to any street, alley, public ground, sidewalk or traveled road or roadway, unless appropriate measures are implemented to prevent the injury of any person or animal.
   (C)   Any person making an excavation shall use all appropriate control measures to prevent pollutants from entering neighboring properties and waters of the state, including municipal storm drain conveyances and natural drainage ways.
