§ 155.012 PLANNING COMMISSION PUBLIC HEARING AND PROJECT REVIEW.
   (A)   Public hearing. The Planning Commission shall hold a public hearing on the preliminary plat. The hearing shall be noticed in accordance with the following procedures:
      (1)   Notices. Upon receipt of the application, one notice that a request for a subdivision has been received shall be published within a newspaper of general circulation within the township. Such notice shall also be sent by mail or by personal delivery to all owners of property to whom real property is assessed as indicated in the township records, to all occupants of all structures within 300 feet of the boundary of the property that is the subject of the application and to the petitioner.
      (2)   Notice timing. Such notice must be given no less than five days nor more than 15 days before the date the application will be considered.
      (3)   Notification items. The notice shall include the following:
         (a)   Describe the nature of the project requested;
         (b)   Indicate the property which is subject of the request;
         (c)   State when and where the request will be considered;
         (d)   Indicate when and where written comments will be received concerning the request.
   (B)   Commission; review. In reviewing the plat, the Planning Commission shall give particular attention to the requirements of §§ 155.017 and 155.018. If the plat meets the requirements of this chapter, the Planning Commission shall give it preliminary approval. The Secretary of the Planning Commission shall forward one copy of the plat along with a notation indicating preliminary approval and any recommendations to the Township Board for Step I approval.
   (C)   If the plat does not meet the requirements of this chapter, the Planning Commission shall:
      (1)   Deny preliminary plat approval, setting forth the reasons in writing; or
      (2)   Grant preliminary plat approval contingent upon completion of the revisions as noted.
   (D)   The Secretary of the Planning Commission shall forward one copy of the preliminary plat along with the Planning Commission's recommendations to the applicant and one copy to the Township Board. The Township Board shall act upon the application within 90 days after it has been filed with the Township Clerk.
