(A) The following terms are defined in a manner intended to make comparison possible between the terms of Ch. 151, this chapter and Ch. 154 of this code of ordinances, and also in the context of Public Act 59 of 1978, being M.C.L.A. §§ 559.101 through 559.272, as amended (sometimes referred to herein as the “Condominium Act”).
(B) For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
BUILDING ENVELOPE. The area of a condominium project within which a condominium structure may be constructed, together with any accessory structures, as described in the master deed for the condominium project. In a single-family residential site condominium project, the BUILDING ENVELOPE refers to the area of each condominium unit within which the dwelling and any accessory structures may be built.
CONDOMINIUM PROJECT. A condominium project developed under the Condominium Act.
CONDOMINIUM STRUCTURE. The principal building or structure intended for or constructed upon a site condominium unit, together with any attached accessory structures (such as, in a residential development, the condominium structure would refer to the house and any attached garage).
MASTER DEED. The legal document prepared and recorded pursuant to Public Act 59 of 1978, as amended, being M.C.L.A. §§ 559.101 through 559.272, to which is attached as exhibits and incorporated by reference the approved by-laws for the project and the approved condominium subdivision plan for the project.
PROJECT. A proposal made to the township, subject to this chapter, for the use or development of property.
SETBACK - FRONT, SIDE AND REAR YARD. The distance measured from the respective front, side and rear yard boundary lines associated with the site condominium unit to the respective front, side and rear of the condominium structure/building envelope.
SITE CONDOMINIUM UNIT. A condominium unit established in compliance with the Condominium Act which consists of an area of vacant land and a volume of vacant air space, designed and intended for separate ownership and use as described in the site condominium project master deed, and within which a building or other improvements may be constructed by the condominium unit owner.
SUBDIVISION ORDINANCE. The Sparta Township Land Subdivision Ordinance (Ch. 151 of this code of ordinances).
(C) Except as otherwise provided by this chapter, the following words and phrases, as well as any other words or phrases used in this chapter which are specifically defined in the Condominium Act, shall conform to the meanings given to them in that Act: “common elements”; “limited common elements”; “condominium documents”; “condominium unit”; and “general common elements”.
