For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
HOME OCCUPATION. An occupation or business carried on by a member of the family occupying a dwelling unit at the same pick-up location, whether or not the occupation or business is located in the dwelling unit or in an accessory building at the pick-up location.
OWNER. A person, partnership, corporation, association, estate, trust, or other organization which holds title to real estate in the town.
PICK-UP LOCATION. Each improved lot and improved parcel of real estate within the town to which service is available under this chapter.
SERVICE. Garbage and rubbish pickup within the town and its sanitary disposal in a sanitary landfill site licensed by the state’s Board of Health, under any contract to which the town is a party. Each user, in this section, shall be subject to the limitations on number and weight of receptacles and type of garbage and rubbish to be picked up as is set forth in any contract between the town and the private contractor to provide garbage and rubbish removal. The frequency of garbage and rubbish pick-up shall be determined also by the contract. A copy of the contract shall be available for inspection at the office of the Clerk-Treasurer.
TOWN. All territory within the corporate limits of the town, as well as the municipal corporation by the name of South Whitley, Indiana, as the context requires.
UNIT. A dwelling, a business, or a commercial, educational, industrial, religious, or other building and other institutions.
USER. The owner and occupant of each unit within the town. Each use by an owner or occupant shall be deemed a separate USER.
