§ 35.23  VACATION PAY.
   (A)   Street and utilities. Pay will be paid based on 40 hours per week for utility and street employees.
   (B)   Police. Pay will be credited for one week's vacation pay based on 42 hours.
   (C)   Clerk-Treasurer. The Clerk-Treasurer is exempt from this article due to being an elected official. The Deputy Clerk-Treasurer and any other full time employees will be paid based on 40 hours per week.
   (D)   Part-time. Part-time employees are not eligible for vacation pay.
   (E)   Administration.
      (1)   The Utilities Supervisor will approve vacation time in advance for all utility and street personnel and the Marshal will approve vacation time for all police personnel. The Clerk-Treasurer shall approve vacation time for the Deputy Clerk and other office staff.
      (2)   All vacation time will be credited in January. Upon termination employees will receive accrued vacation time earned at the current rate of pay. Accrued vacation time will be calculated as of January 1 of the year upon termination, retirement, or resignation. Upon leaving employment, employee must take all accrued vacation or personal time in one lump sum payment.
      (3)   If an employee is terminated before two full years of service, his/her vacation is pro-rated at the rate of 1/12 of his/her vacation entitlement for each month of service for that year.
      (4)   Employees will be limited to four weeks of accumulated vacation time carried forward into a new calendar year; if an employee has any vacation remaining over four weeks then he/she will lose this time. The excess over four weeks will not be compensated for nor will the time be allowed to carry over into the following year. It is requested that all employees take time away from the job.
   (F)   Entitlement. Vacation entitlement shall be awarded for all full time employees as follows:
