When the Town Council determines, by resolution, that any sidewalk within the town is unsafe, unfit, or inconvenient for passage thereover by pedestrians and therefore in need of repair, it shall notify the owners of the adjoining property, either in person or by mail, of the defects in the sidewalk. Further, the notice to the adjoining owner will specify that the owner has a certain period of time (no less than 30 days from the date of the notice) to make the repairs as required by the notice. If a property owner fails to comply with the notice, the Town Council may have the sidewalk repaired by an independent contractor, and assess the property owner the costs of the repair, all in accordance with the provisions of applicable statutes.
