(A) It shall be unlawful for any person to burn either garbage or trash of any kind at any time whatsoever.
(B) Residential leaf disposal burning is prohibited between the hours of 6:00 p.m. and 6:00 a.m. Businesses, institutions, organizations, and multi-family (rental) complexes are prohibited from burning leaves at all times. Burning may not take place on town streets, lots, or alleys.
(C) Recreational and ceremonial fires are permitted subject to restrictions set forth at 326 I.A.C. 4-l-3(c). Specifically, without limitation on the applicability of other restrictions set forth therein:
(1) If the fire creates a nuisance, pollution problem, or fire hazard, it shall be extinguished;
(2) Only clean wood products, paper, charcoal, or clean petroleum products may be burned. The term “clean wood products” does not include: anything stained, painted, coated, or glued; construction, commercial packaging, or business materials; furniture or parts thereof; or other household wooden items;
(3) The fire must be attended at all times and must be extinguished when not attended;
(4) The fire must be in a container with enclosed sides and a bottom; and
(5) Burning may not take place on town streets, lots, or alleys.
(D) Controlled burns of structures and vegetation conducted under the supervision of a public fire department are exempt from the foregoing restrictions.
