§ 52.05 APPEALS.
   (A)   If a customer’s water and sewer bill is greater than 500% of the previous month’s bill because of a leak of the customer’s water line(s), the customer may apply to the Water Department in writing, within 30 days from the date of the bill, requesting an adjustment on the sewage portion of the bill as to the increase in usage that exceeds 500% of the previous month’s bill. There shall be no abatement on the water bill as this water is purchased by the village.
   (B)   In order for the appeal of the sewer bill over 500% of the previous month’s bill to be approved, the customer must prove to the satisfaction of the Village Board that the excessive usage is due to a leak, and that the customer, immediately upon becoming aware of the leak, took all necessary steps to stop the leak.
   (C)   No adjustment will be made for seasonal water usage, not caused by a leak, that exceeds 500% of the previous month’s bill.
   (D)   The Village Board shall have the authority to review and process any request for a reduction in sewer bill due to a leak, and may authorize an adjustment pursuant to the criteria set out above. Each case will be reviewed on an individual basis.
   (E)   The customer must pay the entire water and sewer bill when due, even if a request for an abatement is made, whether or not granted. Failure to timely pay the protested water and sewer bill shall act as an automatic denial of the request for adjustment.
   (G)   An appeal for a leak credit on the sewer portion of the water bill shall not occur more than twice in a 12-month period.
