§ 93.01 DEFINITIONS.
   For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   ABANDONED VEHICLE.
      (1)   Any vehicle in a state of disrepair which results in the vehicle having the reasonable appearance that it is incapable of being driven safely or legally upon the public highways;
      (2)   Any vehicle which has, to all appearances, not been moved or used for seven consecutive days or more and is apparently deserted; or
      (3)   For the purposes of this definition, a vehicle deemed to be abandoned under division (1) above shall be subject to impoundment and the owner shall remain in violation if, after notice procedures provided for in § 93.05 have been carried out, the vehicle remains on any public highway in a state of disrepair, as defined in division (1) above. The fact that the vehicle is moved after it is cited shall not be a defense under division (1) above, nor shall this fact require subsequent notices to the owner before impoundment.
   ANTIQUE VEHICLE. A motor vehicle that is more than 25 years of age or a bonafide replica thereof and which is driven on the highways only going to and from an antique auto show or an exhibition, or for servicing or demonstration, or a firefighting vehicle more than 20 years old which is not used as firefighting equipment but is used only for the purpose of exhibition or demonstration.
   CHIEF OF POLICE. The Chief of Police of the village.
   INOPERABLE MOTOR VEHICLE.
      (1)   Any motor vehicle from which, for a period of at least seven days, wheels or other parts have been removed, or on which the engine, wheels or other parts have been altered, damaged or otherwise so treated that the vehicle is incapable of being driven under its own motor power.
      (2)   Shall not include a motor vehicle which has been rendered temporarily incapable of being driven under its own power in order to perform repair thereon; provided that the repairs are completed within seven days.
   MOTOR VEHICLE. Every device which is self-propelled.
   PERSON. Any person, firm, partnership, association, corporation, company or organization of any kind.
   POLICE DEPARTMENT. The Police Department of the village.
   POLICE OFFICER. A member of the Police Department.
   PRIVATE PROPERTY. Any property not owned by the village, whether owned by an individual, corporation or other private or public entity.
   PROPERTY. Any real property within the village which is not a street or highway.
   STREET or HIGHWAY. The entire width between the boundary lines of every way publicly maintained when any part thereof is open to the use of the public for purposes of vehicular travel.
   VEHICLE. Every device in, upon or by which any person or property is or may be transported or drawn upon a highway, except devices moved by human power and snowmobiles, as defined in the Illinois Snowmobile Registration and Safety Act, being 625 ILCS 40/1-1 et seq.
   VILLAGE. The Village of Southern View, Illinois.
   VILLAGE BOARD. The Board of Trustees of the village.
