(A) In the event the rates or charges for water and sewerage service, or either of them, including any penalty then due, are not paid on or before the due date, a late notice shall be generated.
(B) The late notice shall include the outstanding balance and late fees as set forth in § 51.05(E).
(C) After the fact and amount of any balance is known, the late notice shall be sent to the person who is late in paying the charges or rates for the foregoing services and the notice shall also be sent to the owner or owners of record of the subject real estate if different from the person or persons who is or are late in paying such charges or rates.
(D) Collection of fees. In addition to any outstanding balance, late fees, including any penalty then due, there shall be added and imposed any and all additional fees incurred by the village to collect such debt. The additional fees to be added for a debt referred to a debt collection agency or attorney for collection shall be the greater of:
(1) The actual fees incurred by the village to collect such debt; or
(2) An amount equal to 35% of the debt.
